Disability Discrimination

Console Law Offices LLC is dedicated to protecting the rights of employees or applicants for employment who have been discriminated against because of their disability. The definition of “disabled” under the law is much more narrow than the everyday understanding of the word. To be protected under the disability discrimination laws, an employee must have either: (i) a physical or mental impairment that substantially limits a major life activity (such as walking, seeing, hearing, etc…); (ii) have a record of such an impairment; or, (iii) be regarded as having such an impairment. At the same time, the employee must be qualified to perform the essential functions of his or her job, with or without a reasonable accommodation. An employer must provide the disabled employee with a reasonable accommodation unless it would impose an “undue hardship” on the operation of the employer’s business.

Federal and state laws also prohibit retaliation if the worker complains about disability discrimination or requests a reasonable accommodation; the law also prohibits employers from creating a hostile work environment based on an employee’s disability.
