Former GE worker wins age discrimination suit

A 65-year-old senior engineer at General Electric (GE) in Morrestown won an age discrimination lawsuit against the company.
An eight-member jury on Wednesday awarded Murray Garden, a Montgomery County, Pa., resident, $796,044 plus attorney fees.
This money includes back pay, damages under the Age Discrimination in Employment Act and compensatory damages under the New Jersey Law Against Discrimination.
“They had a ranking system that was age-biased to younger employees,” said Garden’s attorney Stephen G. Console. “Hopefully this will send a message to companies like General Electric.”
“Garden was among a group of employees who were laid off in 1990. Though Garden was a senior employee, he was included on the layoff list because of his “alleged poor performance ranking with the company,” said Console.
GE spokesman Jim Tierney said the company did nothing wrong.
“GE believes its management acted fairly and in a non-discriminatory manner with regard to Mr. Garden,” said Tierney. “We have a rating and evaluation system that is non-discriminatory. Representatives of GE are reviewing the matter to determine whether to appeal the verdict.”
